Former chapter 7 client husband was divorced in another state a number of
years ago. Ex-wife was required to re-fi or sell the home, and ended up in
a chapter 13, wherein she is evidently trying to save it. She has not (and
cannot) refi. Client listed the house debt in his 7 since he was on the
original mortgage, and the Statement of Intention says he's surrendering his
interest. Client is trying to clean up his credit and credit reporting
agency says that since the ex-wife's chapter 13 was first, they can't (or
won't) show it as discharged as to him, even tho he was not involved at all
in the 13. Mortgage lender (SunTrust) says they have to keep his name on it
under federal law and cannot report it as anything else. It's keeping him
from fixing his credit. Any suggestions? In the meantime, I've had
multiple problems with SunTrust failing to properly reconvey deeds of trust,
and have finally found the VP for Lien Releases. If anyone needs that
contact, let me know. Unfortunately, she can't help me with this problem.
