If it's an IRA annuity, then I believe it's exempted as an IRA.  The
difference to the debtor when he sets up one is the taxation and deduction
of contributions, but that makes it an IRA under ERISA.

I have a client that has an annuity within an IRA. Does the fact that it is
within an IRA change the way it is exempted? Other than the fact that the
"plan type" states it is an IRA ,it appears to be an annuity in terms of how
it will be paid out, cash value, etc....
