All:
I have some clients who have been in a Chapter 13 for about three years
now. However, they recently filed for divorce and are living in separate
residences. I filed a motion to convert to a Chapter 7, but I think what I
needed to have done is file a motion to bifurcate the Chapter 13 into two
individual Chapter 7s. I have not done this before and am wondering what
authority I would rely on in my motion? Can someone point me to a code
section or rule of Federal Procedure that the BK code adopted? I would
appreciate any help!
Thanks,
Megan
