Now the interesting question re: "Stern claims" becomes whether the BAP has appellate jurisdiction - or whether appeals of "Stern Claims" (final decision of which now appears to come from the District Court) must go directly to the Ninth Circuit. Seems like "Stern Claims" would necessarily go directly to the Ninth Circuit...the BAP is an alternative to District Court appeals, not Ninth Circuit appeals. It'll be interesting to see what happens with BAP cases (both new, and currently pending)...
