If partition would work a hardship, the court could order it sold as a whole.

Is anyone familiar with filing a judicial action for partition of real estate owned by three tenants in common?  Is there an absolute right to have the property partitioned (which in this case would require a sale as the property could not be physically divided)?

 

Any help on how to proceed would be appreciated.
