I put on a webinar CLE last year on Discharging Taxes in Bankruptcy.  It was free and you might be able to view it.   The state bar may have a copy of it for you to obtain and watch.  If not, I could post it on one of my websites and make it available.  It is a complicated subject with lots of pitfals.

My practice is to have my client (or you can via a POA), get their tax ACCOUNT transcripts (you must use that magic word), then you will see everything that has happened with their taxes from the time they filed them, i.e., any assessments at some time after filing, whether they filed late, or any action, that may affect the dischargeability date.

Listmates,

Over the few years that I've practiced in this field I've had only a handful of clients who have owed tax debts at the time of filing. On each of those filings where taxes were owed none of them have ever fallen into the narrow qualification for tax discharge, until recently. I've checked and double checked and I'm fairly certain that finally come across a couple who might qualify for a discharge of their taxes. I'm getting ready to file a chapter 7 and my question is: What steps to I need to take to ensure that these debts are actually discharged? I would appreciate any guidance that you may have in this area. Thank you.
