I have a client that is insisting if the mortgage lienholder can't produce a wet ink copy of the original paperwork the debt becomes unsecured in a bankruptcy. I told them I knew in the 2010's there were some problems with Robo signing but did not know about this. As much as I would love this to be true I can not find any recent authority on it. I'm not even sure it is a bankruptcy matter and may belong in State Court. Any input would be appreciated.
