[CLBS] CVAH - extended fraudulent transfer lookback period

The attached Memo Decision, issued earlier today by Judge Pappas, should be of some interest. The issues included (a) whether a Chapter 7 Trustee could use the 6-year lookback period provided by the Federal Debt Collection Procedures Act when the IRS is a creditor; and (b) whether, also when the IRS is a creditor, the Trustee could take advantage of the Internal Revenue Code provisions making state-law fraudulent transfer statutes of limitation (i.e., Idaho's 4-year statute) inapplicable. In both cases, Judge Pappas' answer was "yes". Bottom line = Trustees now can pursue fraudulent transfers (when the IRS is a creditor) at least as far back as six (6) years pre-petition, if not more.
