Message-ID: <05ec01d55140$b704ce80$250e6b80$@roarklawboise.com> Corporate borrower got caught up with hard money lender in NY. As part of the loan paperwork, debtor signed a confession of judgment. Debtor defaulted. Judgment entered in NY. Bank accounts in ID levied. I cannot find a domesticated case in ID for this. Is the bank wrong in seizing the funds based on a NY confession of judgment that has not been domesticated? The lender does have a UCC-1 filed in ID so arguably does have a lien on the proceeds. If I do a motion to redeem under 11 U.S.C. 722 can I name both creditors and redeem for the single value of $2,000 paid to the credit union? I feel like each creditor is entitled to their "allowed, secured claim" which may mean the best case scenario (besides letting it go) is getting an order that they each must be paid $2,000 to redeem. The credit union isn't going to help my client get the boat from the mechanic as they are obviously not happy with him. Thanks in advance. She lived in Seaside Oregon for 5 years prior. She needs to file in Oregon. The kicker is 5 years ago she gave her mobile home to her son when she left Alabama. He failed to make payments and Ditech has a judgment. I told her I couldn't help not being licensed in Oregon and a bankruptcy would only stall the action.
