I don't think your wildcard exemption will protect it unless it's reduced to cold, hard cash because of the tangibility requirement. You might want to look at the Farnsworth case (the case that reversed course and held additional child tax credit were exempt under 11-603(4) back in 2016) and see if it meets the elements of public assistance under 11-603(4) and could be exempted that way. ~ Alex On Fri, Apr 3, 2020 at 11:32 AM wrote: > So the Stimulus funds are excluded from the definition of income, but can > the Trustee in a chapter 7 seized those funds if they have not been > received before filing or if received, would those funds need to then be > spent or held as part of debtor's wildcard at the time of filing? > > Thanks. > > Jon R. Unless the Idaho Supreme Court has ruled that the statute applies extraterritorially in the last 10 years then I think Capps is still good law. ~ Alex On Fri, Apr 3, 2020 at 11:32 AM wrote: > So the Stimulus funds are excluded from the definition of income, but > can the Trustee in a chapter 7 seized those funds if they have not > been received before filing or if received, would those funds need to > then be spent or held as part of debtor's wildcard at the time of filing? > > Thanks. > > Jon R. One that I've had great luck with is Annette Moore at Bookkeeping Plus. She's very reasonable, works hard, and can do reconstructions if needed. I had a very complex 11 a couple of years ago over in Baker where the owner had things completely messed up and she got everything fixed, new financials done, various tax returns filed, and even made the State of Oregon happy. I've got her working in another case right now. I also know some good CPA's that I recommend, depending on the location. Let me know if you want more info. D. Blair Clark LAW OFFICES OF D. On March 9, 2020, I filed a Chapter 13 on behalf of a client who had a pending foreclosure. The arrearages are paid through the 100% Plan and the regular post-petition payments are being made outside the plan and are current. Since the filing the debtors have received at least 2 notices entitled ?Notice of Postponed Trustee?s Sale?, each one continuing the Trustee?s sale for a few weeks. There is no local counsel involved. Each time the debtors receive one of these notices they get distressed. The plan is not yet confirmed. Confirmation hearing is set for early May, 2020. Question: Are these notices not a violation of the Automatic Stay? Can the notices continue because the plan is not yet confirmed? Also, is there not some sort of moratorium on foreclosures due to covid-19? Thanks in advance for your help. Thanks! See below. Patrick J. Geile Foley Freeman PLLC (208) 947-1563 From: Patricia Johnson Sent: Monday, April 27, 2020 8:09 PM To: Patrick Geile Subject: RE: Questions Patrick, Thank you for the presentation today. I don't have a question, but want to share that debtors in bankruptcy or who file prior to disbursement of a PPP loan are not eligible in response to questions today. See the attached highlighted (pages 8 and 9) updated final rule. I wouldn't be surprised if the question as to the impact of a filing after receipt of a PPP loan will come up in the future if the filing is close in time to receipt of the PPP loan.
