Most of you have already seen the notice below but I wanted to post to the list serve.

Counsel:

The U.S. Trustee’s Office has provided additional guidance regarding 341 meetings.  There will be no in-person 341 meetings until further notice.  First meetings will be conducted via telephone conference.


  1.  March 19, 2020 341 Meetings – These meetings will be reset for Thursday, April 9, 2020.  We are not changing the time of the first meeting.  For example, if the meeting was originally set for 8:00 a.m. on March 19, 2020, then the meeting will be conducted on April 9, 2020 at 8:00 a.m.  This week, I will be filing a notice in each case resetting the first meeting and providing instructions for a conference call-in line.  All debtors and attorneys should call into the line ten minutes prior to the start of the meeting.  We will then call each case scheduled for that hour.



  1.  April 2, 16, and 30, 2020 341 Meetings – These meetings will continue as scheduled, but will be telephonic meetings.  This week, I will be filing a notice in each case providing instructions for a conference call-in line.  All debtors and attorneys should call into the line ten minutes prior to the start of the meeting.  We will then call each case scheduled for that hour.  Telephonic meetings may also continue beyond April 30, 2020.



  1.  Conference Line Information for Noah Hillen – Each trustee will have a unique conference line.  My conference line phone number is (877) 386-7687.  The participant code is 8741318.  The first meeting notices mentioned in items one and two above will also provide this call-in information.



  1.  341 Meeting Instructions for Debtor’s Counsel – I have attached instructions for Debtor’s counsel for attending the telephonic first meetings.  Please review this document.  Note, that Debtor’s counsel will now be required to verify their clients’ identification and Social Security Numbers.  Debtor’s counsel will also need to be in video communication with their client during the meeting, via Skype, Facetime, or other conferencing software. Debtors who cannot communicate with their attorney via a video communication system must copy, scan, or take a picture of their identification and proof of social security number and mail / email / send the copies or images to my office no later than two days prior to the meeting of creditors.



  1.  Bankruptcy Information Sheet – Attached is a copy of the Bankruptcy Information Sheet.  Please ensure your clients review this sheet in advance of the 341 meeting.



  1.  Interpreter Cases – If your clients will need the assistance of an interpreter, then contact my office at least two days prior to the 341 meeting.  My office will make sure that an interpreter is available for the 341 meeting.  If your client will need the assistance of an ASL interpreter, then please contact me as soon as possible, as we will need to make special arrangements for an ASL interpret.

Effective immediately, all in-person chapter 7, 11, 12, and 13 section 341 meetings scheduled through April 10, 2020, are continued until a later date to be determined.  Appropriate notice will be provided to parties in accordance with the bankruptcy code and rules.

Counsel:  Please immediately advise your clients of the continued first meetings.   The U.S. Trustee’s Office has requested the court post a notice on its website.  The U.S. Trustee’s Office will also post a notice on its website.

Absent special circumstances, section 341 meetings may not proceed during this period except through telephonic or other alternative means not requiring personal appearance by debtors.   Eventually, we will have conference call lines set up for 341 meetings, however, for those meetings scheduled during the next week or so, there is inadequate time to arrange and provide notice to parties for telephonic 341 meetings.  These meetings will be continued to a date to be determined.

I do not know what future date meetings will be continued to.  I will provide additional information when it becomes available.
