Message-ID: <063901d84929$9abfaf90$d03f0eb0$@roarklawboise.com> I have not seen this on a tax return until now. Is the "American Opportunity Credit from Form 8863, line 8" exempt? Also, is the ACTC exempt? I have forgotten. The ACTC is exempt - see Farnsworth. 2021 is a weird year because the Child Tax Credit and the Additional Child Tax Credit became the Refundable Child Tax Credit. There's a lot of negotiating currently going on between ch 7 trustees and debtors attorneys this year on the refundable child tax credit issue and what portion is exempt and what portion is not. Not aware of any case that has been tee'd up to test the issue. ~Alex On Tue, Apr 5, 2022 at 2:14 PM Holly Roark wrote: > I have not seen this on a tax return until now. More information regarding this rebate can be found here: https://protect-us.mimecast.com/s/-FklCkRLj7fqX2DoT2gvkJ?domain=tax.idaho.gov Pursuant to the Income Tax Turnover Order, your friendly chapter 13 trustee asks that you debtors' counsel out there inquire with your chapter 13 clients as to their receipt of the tax rebates and remind them that they may need to turnover the tax rebate just as they would any tax refund. You may also want to inquire as to whether they received and turned over the tax rebate they received last year as well. Please contact the trustee's office if you have any questions.
