From rgreenwood at greenwoodlaw.com Wed Aug 2 13:44:00 2023 From: rgreenwood at greenwoodlaw.com (Richard Greenwood) Date: Wed, 2 Aug 2023 13:44:00 -0600 Subject: [CLBS] rule change - automatic DQ of judges Message-ID: <49a37ed2-17dc-12d9-0a56-3901397e7f9d@greenwoodlaw.com> CAUTION: This email originated outside the State of Idaho network. Verify links and attachments BEFORE you click or open, even if you recognize and/or trust the sender. Contact your agency service desk with any concerns. The Idaho Supreme Curt is considering permanently abolishing the ability of lawyers and their clients to disqualify Judges without cause.? For those of you who toil in the trenches of state? court litigation, criminal and civil, you have a chance to voice your opposition. I urge you to do so. The Administrative judges have voted in favor of repeal of the rule and I suspect the Supremes are leaning strongly in the direction of eliminating the DQ without cause. Unless the bar is vocal about this, you are going to lose what I think is a valuable right. "The Court is reexamining the rules to assess whether they strike the appropriate balance between protecting the rights of litigants and ensuring the timely, fair, and impartial resolution of cases. Having received comments from the ADJs, the Court now seeks any responses, comments, or suggestions that the Bar and judges may wish to provide. Members of the Bar may provide this feedback anonymously through this survey link https://protect-us.mimecast.com/s/eiUSCYEmY5UPO2k3f0SUBO?domain=idcourts.ca1.qualtrics.com /*You have until Friday, Aug. 4, to provide your feedback,*/ at which point the Court will close the link. All comments will be shared with the Court for its consideration. This survey and its comment fields are designed to capture the necessary information for the Court?s decision. If desired, formal correspondence on this topic can be sent to surveys at idcourts.net."
