For holidays worked, the employee is eligible for state overtime at the hour for hour rate if the number of hours worked does not rise to the number required for FLSA overtime. (See rules 21.7 - 21.9 for state overtime provisions). In addition, many agencies have established shift differential policies that provide an additional premium for working an undesirable shift, such as on a holiday. For shifts that fall partially on a holiday, like a 6pm to 6am shift, it is my understanding that the employee would need to take annual leave for the portion of the shift that does not fall on the holiday. These positions differ from our Attorney class series positions which provide professional legal services and legal protection against lawsuits opposed to the interests of the state; provide prosecutorial assistance to enforce regulations or laws; and represent the state in legal matters that result from day to day operation of the business of the state. Attorney class positions require delegation from the Office of the Attorney General. By contrast, positions performing General Counsel work do not require delegation from the Office of the Attorney General. The purpose of these positions is providing legal advice and counsel, legal direction, and supervision to all of the Department's legal activities. These functions include the oversight, direction, and coordination of the Department's contracts, litigation, legal advice, data privacy functions, administrative law functions, rulemaking, legal policies, negotiations and settlements, and legal compliance activities. Depending on the size and complexity of the agency, General Counsel positions currently span from the individual contributor level to Manager level.
