We are currently reviewing the State's Information Technology's Computer Operation family to assess if the family is appropriately structured and marketable compensation is maintained. Our Computer Operations Center could also be considered a Network Operations Center. The positions currently assigned to the Computer Operations Center have three (3) areas of responsibilities. Printing responsibilities are typically the focus of new employees. As aptitude is assessed, they are assigned higher-level duties. The below areas are listed from entry-level to advanced-level. 1. Responsible for operating high volume equipment to print secure materials, such as checks, motor vehicle titles, W-2 forms, etc. 2. Provide afterhours client support services. Receive phone call and perform basic troubleshooting, such as unlocking and resetting user accounts, resetting Virtual Desktop Infrastructure (VDI) machines, re-distributing secure identification (RSA) tokens, etc. 3. Monitor systems in the State Data Center and triage incidents and problems. Escalate issues to appropriate staff and send outage/maintenance notifications, as needed. Assist and consult with senior staff to resolve and document issues. Monitor and respond to issues regarding environmental cooling systems, electrical systems (including uninterruptible power supply (UPS) and generators), fire alarms and suppression systems, etc. Please provide answers to the following questions to the best of your ability. We would appreciate any additional information you believe to be relevant to our study. 1. What is your classification structure in the Computer Operations area? Please attach relative class specifications. (Add to attached spreadsheet) 2. Please provide the low, high, and average salaries of employees in the relevant job classes. (Add to attached spreadsheet) 3. Are your positions responsible for all of the above areas or just some? Please explain. 4. The State of Missouri has a different area responsible for high volume printing that does not involve secure documents. The State of West Virginia is not currently offering an incentive for those who plan to get the vaccine. More information on this and on how the State will handle the situations with employees who will not be receiving a vaccine, either for religious or medical reasons, are detailed below from our Employee Relations Section of the Division of Personnel. The state of WV has provided agencies the discretion to implement policies and procedures in accordance with the needs of the agency's business. The Equal Employment Opportunity Commission (EEOC) website provides, an employer may ask if an employee has been vaccinated. However, there are confidentiality and liability risks associated with doing so. Simply requesting proof of receipt of a COVID-19 vaccination is not likely to violate EEOC restrictions on disability-related inquiries and medical exams. However, subsequent questions, such as asking why an individual did not receive a vaccination, may elicit information about a disability and be subject to the applicable ADA standard that the inquiry is "job-related and consistent with business necessity." Also, there is some risk associated with learning who is and is not vaccinated since it can be a decision made on protected status. Under the ADA and Title VII, an employee may be entitled to an exemption from a mandatory vaccination requirement based on a medical condition, disability, or sincerely held religious belief. Knowledge of an employee's protected status may increase their risk for discrimination complaints. Prior to implementing policies or programs that would require asking and/or requesting proof of vaccination, the Division of Personnel (DOP) is advising state agencies to consider the following; * The ADA and Title VII of the Civil Rights Act of 1964 prohibits employers from compelling employees to take the COVID-19 vaccine regardless of their medical conditions or their religious beliefs during a pandemic. * Will requiring employees to provide their vaccination status, refusal, or inability to be vaccinated be viewed as compelling, especially if an employee fears they may become subject to retaliation or discrimination based on their status? * What is the intent behind acquiring the knowledge? Will knowledge of an employee's vaccination status affect the conditions of their employment, such as job duties or physical location? * An employee's response regarding vaccination is considered confidential medical information. How does the agency intend to secure the physical and/or electronic information as well as any unintended disclosure among staff? In the case of incentive programs, I think it would be important to consider whether withholding the incentive will give the appearance of discrimination toward individuals with disabilities or sincerely held religious beliefs. Following is the key paragraph from a message sent to all WI state employees 3 weeks ago (March 3). Religious objections are subject to the usual process of exploring accommodation. With limited exceptions, such as for some state employees working directly with patients in in-patient settings or correctional staff, state agencies will not coordinate vaccine access for state employees. If you are currently eligible, we encourage you to talk to your doctor, pharmacist, or find a community clinic with the vaccine in your area. Once vaccine supply is more plentiful and all employees are eligible, we will provide further information about employer-based clinics that will be available to state employees in a manner similar to how we encourage annual flu vaccinations.
