RE: Implementation and Enforcement of 2023 NEC Requirements


Effective April 19, 2024, the Division of Occupational & Professional Licenses has transitioned to the 2023 NEC Code cycle with the exceptions outlined in temporary administrative rules. Over the coming months, we will be undergoing negotiated rulemaking to finalize proposed changes. Following that process, rules will be presented to the legislature in early 2025 for consideration. In the meantime, the temporary rules will be in effect through the end of the 2025 legislative session.

Permits obtained before April 19, 2024, will adhere to the 2017 NEC code during inspections. Any permits pulled after that date are subject to the current requirements. All exceptions are in effect as of April 19, 2024; contractors and homeowners will be notified of any code changes discovered during inspections that must be complied with for future permits. Consistent with the legislature's action, we have begun implementation of the 2023 NEC code. However, to ensure business continuity and to minimize disruption, we plan to engage in a multi-phased approach to enforcement via education, outreach, and training, with full enforcement commencing no later than January 1, 2025.
