[CLBS] 2 situations

Listmates:

 

1.       Client owed money to a credit union for a deficiency.  Credit union
sent him a 1099 for the entire amount of the deficiency and told him they
were through with him and not to call again.  Automated Accounts is suing
him for the deficiency (he hasn't been served yet).  Didn't credit union
make an election of remedies?  They're going to get a 100% write off of this
debt.  Seems to me it's a double dip.  I plan to get a copy of the complaint
and 1099 and talk to AA's attorney, but if I'm stonewalled, I'd appreciate
some guidance.  Has anyone else run into this with AA?

2.       Who is the paralegal in Eastern or Southern Idaho who does well
with making compromises with collection agencies?  Again Automated Accounts,
different client.  They offered her a 20% discount on 3 debts that were
assigned to them, she countered with 25-30% payment on the debt, they said
pay 80% or we continue our active lawsuit.  She's trying very hard to stay
out of bankruptcy.
