You may want to read the opinion. It does cite Grimmett, Seare, and
Castorena. While it says you could in theory do it, it is a pretty high
hurdle to overcome.
Also, there are objections on this Utah ethics opinion because it is based
off a hypothetical and some incorrect facts. The objections are asking for
a rewrite/review based on properly based case law and practices. Reading
the opinion you can see there are some assumptions that I don't think are
accurate for Utah and I don't think translate to the 9th Circuit or Idaho
either.
As Ms. McCallister cited earlier, Hirsch, there are cases still pending
where we may end up with our own Idaho ethics opinion on this very matter.
