[CLBS] Possibility and practically of Setting Aside Foreclosure Sale

Dear List Mates:

 

Have been contacted by individual regarding a foreclosure sale which was
held despite the lender having accepted mortgage payments the 3 months prior
to the sale date.  Payments were electronically paid to the Lender via bank
account.

After the sale, client has received 2 of 3 payments back in predated
envelopes with letter of explanation & check dated near the date stamp of
the envelopes.  Third house payment has not been received almost a month
after the sale.

Allegedly, the re-noticed Sale Date was not posted on his door and neighbor
would testify to that fact.   The certified mail receipts to Mortgagee show
notice of sale letters were "unclaimed," but individual claims he did not
receive any notice of certified mail to be picked up.

 

Are there any list mates who have experience in setting aside a foreclosure
sale like to discuss the matter with me?
