[CLBS] In re Wright/BK Billing

Paul, Thank you for sharing this decision with the group. I have been adamantly opposed to this kind of billing practice and bifurcation of bankruptcy legal services ever since its use first appeared here in Idaho. I think that it is unethical and conflicts with our obligations to our clients under the Bankruptcy Code. I like the Court's reasoning in the Wright decision. What do you think the odds are that the U.S. Trustee's office for the District of Idaho might go after the lawyers who have been engaging in a similar practice here now that the In re Wright decision has come down? It is pretty clear from the presentation by bar counsel at this year's CLE in February that bar counsel isn't going to do it and is leaving it to the U.S. Bankruptcy Court to decide the issue. Chapter 7 Trustee Noah Hillen attempted to bring the issue before the Court, and he was shut down as not having the appropriate standing to raise the issue. Now it is really up to our U.S. Trustee's office to make it happen. Thoughts anyone? Sincerely, Bart Green
