Hi Cliff, here is the response from WA Department of Agriculture:
1. Does WA have a Livestock Board [or equivalent] and if so, do they set performance expectations for livestock inspectors? If yes, please provide a copy of or link to the expectations. Washington has a Livestock Identification Advisory Board established in law (RCW 16.57), but that board does not set performance expectations for inspectors. Performance expectations for inspectors are set by the Manager and Supervisors, who are state employees with Washington State Department of Agriculture. The Advisory Board only advises the Director of Agriculture on proposed rulemaking, fees, etc.
1. Does AGR have an assessment where candidates for hire are put in a pen with various cattle [or other animal] in order to identify the "make and model" of each animal using specific techniques to heard and sort so brands can be identified? Or something equivalent? No. AGR does not have an assessment for candidates where we put them in a pen with animals to identify Identification of livestock. AGR uses a written test for candidates that will be interviewed. The written test includes:
Having the candidates describe breeds /colors/location of brands/ of animals based on pictures
Mathematical skills based on livestock ID fees
Having the candidate describe how they would handle scenarios
Drawing brands, providing a written description of the brands
If yes:
* Is your agency having difficulty administering these performance-based tests due to the public health emergency? We have only had 1 brand inspector recruitment during this public health emergency.
* What adjustments have you made to accommodate in person testing? We limited the amount of AGR staff on the interview panel, conducted the interview at a public venue where our staff member(s) and the candidate could sit 6 plus feet apart, and all wore masks.

I reviewed Director Garland's emails, the proposed scenario-based written exam and evaluation sheet, and the documentation of SPO's 2015-2016 approval of HED's written assessment. I also discussed NMLB's request with Pam. Here's what we need your help gathering in order to make a thorough analysis and gain a greater degree of comfort with the suggested examination change:
1. From you:
* Information/documentation of previous instances where the SPO Director approved a written test to substitute for a performance-based one.
* Information/documentation of previous instances where a written test has been the only test for a practical job, as opposed to just supplementing a performance-based test.
* Information about other agencies that use performance-based tests. Are they also having difficulty administering their performance-based tests due to the public health emergency? What adjustments have they made? For example, is NMDOT still testing their drivers? And if so, how? What are livestock boards in nearby states doing?
1. From NMLB:
* Length of time NMLB is requesting to use the scenario-based question test in lieu of the performance-based one.
* List of NMLB employees/subject matter experts who helped Director Garland create the scenario-based question test, including their backgrounds/credentials.
* Written statement signed by Director Garland and General Counsel Rasmussen sanctioning this temporary change to NMLB's examination process.
* Written process for scenario-based question test.
i. What will exact process be for administering the test?
* As part of the interview?
* Questions presented orally or on paper? Answered orally or in writing?
* Who will grade the answers? The interviewer(s)? How will NMLB ensure the interviewer is qualified to grade?
* How will NMLB keep track of who has taken the test?
ii. Process should require Director Garland to sign off on each use of the scenario-based question test, ensuring compliance with the process.
iii. How will applicants with learning disabilities (who do not test well with paper) be accommodated?
Please provide your portion of the information to me by this Friday.

Wow!?! They've created a very competency-based assessment that I think will work quite well. All the elements to be assessed in the performance test are there. SMEs created detailed scenario-based questions, there is a score sheet for raters to use who know what the proper responses should be. They did the work for us. What do you think?

After our meeting on Monday, our Legal Counsel, Leif Rasmussen, and I spoke about our Waiver to the Field Performance Test. He and I agree that the waiver will be OK with some tools put in place to help ensure we are not placing the agency at risk. So with that in mind several employees and I have developed 12 scenario questions, to be given at the interview, that will give us a good idea if the applicant has any knowledge of handling of livestock. We have also developed an evaluation sheet to be used by the person who will be training the new employee in the field. We feel this evaluation sheet will be good documentation in the event a new employee must be terminated or there are problems that evolve out of the employment. The questions and evaluations are attached for you to review.
We are in the process of trying to hire for 3 new inspectors, so your attention to this request in the near future would be greatly appreciated.
