Please see New York's responses:
1. Yes, shift pay differentials.
1. Full-time permanent employees. Temporary, hourly employees are not eligible, but agencies could choose to offer a shift differential by factoring the premium into an employee's hourly rate. Permanent employees participating in NY's voluntary reduction in work schedule program (60%, 80%, etc.), receive a prorated amount based on shifts worked.
1. Authorized for employees who are "regularly assigned" to "a work shift other than a normal day shift." Regularly assigned is defined as scheduled to work a shift other than a normal day shift on an other than temporary basis. See answer to question #4 as well.
1. Not defined by hours. An employee is considered regularly assigned to a night or evening shift if the employee works no less than 10 working days in a 2-week period on such a shift. An employee regularly assigned to the day shift whose schedule is changed to a night shift for 1 or 2 days is ineligible for a shift pay differential because the assignment is temporary.
1. Evening and night, including weekend evening and night shifts. However, there is currently no statutory ability to pay a weekend premium to employees who work day shifts on the weekend.
1. Varying rates by occupation. Shift pay differentials are approved for titles as annual amounts and divided into each pay check. See https://www.cs.ny.gov/sstse/index.cfm, and run for Shift Pay Differentials (130.6) for approved amounts for specific titles. This will provide you with a general sense of approved amounts.

The State of NC is considering revising our Shift Premium Pay Policy. We would appreciate a response to the questions below. If at all possible, please reply to Lorence Crossett at Lorence.Crossett at nc.gov<mailto:Lorence.Crossett at nc.gov> by February 17, 2021.
1. Does your state provide additional compensation to staff working on shifts outside of "normal" designated working hours (Example: shift premium pay, shift differential pay, etc.)?
2. Types of employees eligible to receive this Shift Premium Pay (Example: permanent, temporary, full time, part time, etc.)?
3. How is shift premium pay earned? (Example: for hours routinely worked, irregular schedules)?
4. Minimum hours an employee has to work on a shift to be eligible, and receive Shift Premium Pay (Example: 8hrs or the entire shift, 4hrs, etc.)?
5. Hours/Shifts that are eligible for this Shift Premium pay (Example: evening, night, weekend, etc.)?
6. Rate of pay for this Shift Premium Pay (Example: Flat $ rate, % of employee hourly rate, etc.)?
